These Terms of Sale apply to all orders placed through www.jlbrooks.co.uk and govern the sale of goods by J L Brooks Ltd (“we”, “us”, “our”) to customers (“you”, “your”).
By placing an order via our website, you confirm that you have read, understood, and agree to these Terms of Sale.

- SCOPE & CUSTOMER TYPE
These Terms apply to both:
- Business customers (B2B) purchasing in the course of trade, and
- Consumers (B2C) purchasing for personal use
Where terms differ, this is clearly stated. Nothing in these Terms affects statutory consumer rights that cannot legally be excluded.
- FORMATION OF CONTRACT
- Placing an order on our website constitutes an offer to purchase goods
- An automated order confirmation email does not constitute acceptance
- A legally binding contract is formed only when goods are dispatched or we explicitly confirm acceptance
We reserve the right to:
- Refuse or cancel any order prior to dispatch
- Limit quantities
- Reject orders where pricing, stock, or customer details are incorrect
- PRODUCT INFORMATION & AVAILABILITY
- Product images are for illustration only
- Pack sizes, ingredients, and specifications may change due to supplier updates
- Availability is subject to stock at time of dispatch
We reserve the right to substitute equivalent products where necessary, or cancel orders where substitution is not appropriate.
- PRICING & VAT
- All prices are shown in GBP (£)
- VAT is charged at the prevailing rate where applicable
- Prices exclude delivery charges unless stated otherwise
Despite reasonable care, pricing errors may occur. If an error is identified:
- We will contact you before dispatch
- You may choose to proceed at the corrected price or receive a full refund
- PAYMENT
Payment is taken at checkout using approved payment providers via BigCommerce.
We accept:
- Debit and credit cards
- Other payment methods displayed at checkout
Orders will not be dispatched until payment is successfully authorised.
- DELIVERY
7.1 Delivery Times
- Delivery dates are estimates, not guarantees
- We are not liable for delays caused by couriers, weather, or circumstances beyond our control
7.2 Risk & Title
- Risk passes on delivery
- Title passes once payment is received in full
- BUSINESS CUSTOMERS (B2B) – IMPORTANT TERMS
For customers purchasing in the course of business:
- Goods are sold as described, but suitability for resale or use is your responsibility
- We do not accept liability for:
- Loss of profit
- Loss of business
- Indirect or consequential losses
Returns are not accepted for business customers unless goods are faulty or incorrect.
- CONSUMER RIGHTS (B2C)
Consumers have statutory rights under the Consumer Rights Act 2015.
9.1 Faulty or Incorrect Goods
If goods are faulty, damaged, or not as described, you are entitled to:
- Repair, replacement, or refund in accordance with the law
9.2 Right to Cancel
Due to the nature of our goods (food, drink, consumables):
- Perishable or sealed items are exempt from the 14-day cooling-off period once opened
- Non-perishable, unopened goods may be returned within 14 days of delivery
Return postage is the customer’s responsibility unless goods are faulty.
- RETURNS & REFUNDS (ALL CUSTOMERS)
- Returns must be authorised in advance
- Goods must be unused, unopened, and in resaleable condition
- Refunds are processed to the original payment method
We reserve the right to refuse returns that do not meet these conditions.
- PROMOTIONS & DISCOUNTS
- Discount codes are non-transferable
- Only one promotion may be applied per order unless stated
- We reserve the right to withdraw promotions at any time
- FORCE MAJEURE
We shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to:
- Supplier failure
- Fuel shortages
- Industrial action
- Severe weather
- System outages
- LIMITATION OF LIABILITY
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
Subject to this:
- Our total liability shall not exceed the value of the goods supplied
- We are not liable for indirect, economic, or consequential losses
- DATA PROTECTION
Personal data is processed in accordance with our Privacy Policy. By placing an order, you confirm all information provided is accurate.
- GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of England and Wales.
The English courts shall have exclusive jurisdiction.
- SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force.
